Terms of Service — DojoDash

By using DojoDash you agree to these terms. Read them.

1. What DojoDash is

DojoDash is a marketplace platform that connects independent coaches with clients seeking in-person training. DojoDash is not a training provider. Coaches are independent contractors, not DojoDash employees.

2. Eligibility

DojoDash is strictly for users 18 years of age or older. This applies both to account holders and to anyone receiving training through the platform — DojoDash does not permit minors to be trained, booked for, or otherwise participate in sessions under any circumstances, including when booked by a parent or guardian. Registration constitutes your representation that you are at least 18. Accounts found to be created by, or booking sessions on behalf of, anyone under 18 will be terminated immediately.

3. Coach responsibilities

Coaches agree to: accurately represent their credentials and experience, conduct sessions safely and professionally, show up on time or cancel with reasonable notice, and comply with all applicable laws.

4. Client responsibilities

Clients agree to: provide accurate session location information, be present and ready at the booked time, treat coaches with respect, and not book sessions under false pretenses.

5. Background checks

DojoDash offers an optional background check badge for coaches through Checkr. This badge indicates a coach has cleared a standard background check. DojoDash does not independently verify credentials, certifications, or training experience beyond the background check. Clients are responsible for reviewing coach profiles before booking.

6. Payments and fees

DojoDash charges clients a platform session rate at the time of booking. Coaches receive approximately 80% of the session rate (exact split visible at booking). Payments are processed by Stripe. All sales are final unless a session is cancelled before it begins.

7. Cancellations

Clients may cancel a session before it is confirmed by the coach at no charge. Cancellation policies for confirmed sessions are subject to update — current policy is displayed at booking. Coaches who cancel after confirmation without adequate notice may be subject to account review.

8. Safety

DojoDash provides a Safety Center and SOS alert logging feature. These tools are supplementary and do not replace calling 911 in an emergency. DojoDash is not responsible for incidents that occur during in-person sessions. If you feel unsafe, leave immediately and contact emergency services.

9. Assumption of Risk and Release of Liability

Training offered through DojoDash — including personal training, self-defense instruction, and Brazilian Jiu-Jitsu — involves inherent physical risk, including but not limited to sprains, strains, joint injuries, bruising, and in rare cases serious injury. By booking a session, you acknowledge these risks and voluntarily assume them. You release DojoDash, its officers, and affiliates from liability for injury, illness, or damages arising from participation in any session, to the fullest extent permitted by law. This release does not apply to injuries caused by DojoDash's gross negligence or willful misconduct. Users must affirmatively accept this section before their first booking, separate from general Terms acceptance.

10. Background Check Disclosure and Authorization

As a condition of becoming a Coach on DojoDash, you authorize DojoDash to obtain a background check report through Checkr, a consumer reporting agency, for purposes of verifying your eligibility to provide services on the platform. You have the right to request a copy of your report and to dispute inaccurate information directly with Checkr. If information in your report may result in adverse action (such as removal from the platform), you will be notified and given an opportunity to respond before a final decision is made, in accordance with the Fair Credit Reporting Act.

11. Coach Insurance

Coaches are independent contractors and are solely responsible for maintaining their own liability insurance appropriate to the services they offer. DojoDash may require proof of insurance as a condition of maintaining an active Coach profile.

12. Indemnification

You agree to indemnify and hold harmless DojoDash, its officers, and affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the platform, your violation of these Terms, or your conduct in connection with any session.

13. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles. Any disputes arising from these Terms or use of the platform shall be resolved in the state or federal courts located in Florida, and you consent to the jurisdiction of those courts.

14. Limitation of liability

DojoDash is a marketplace platform. We are not liable for the conduct of coaches or clients, injuries sustained during sessions, or any damages arising from use of the platform, to the maximum extent permitted by law.

15. Disputes between users

Disputes between clients and coaches are between those parties. DojoDash may assist in resolving disputes at its discretion but is not obligated to do so.

16. Changes

We may update these terms. Continued use of DojoDash after changes constitutes acceptance.
